Establishment of United States Space Force

Space Policy Directive 4 directed the Department of Defense to establish the United States Space Force as a new armed service within the Department of the Air Force. The directive initially raised separation of powers questions because Article I, Section 8 grants Congress the power to "raise and support Armies" and to "provide and maintain a Navy," suggesting that creating a new military branch requires legislative action. However, the constitutional concern was resolved when Congress formally established the Space Force through the National Defense Authorization Act for Fiscal Year 2020.
